REFLEKSI HUKUM ISLAM TERHADAP FENOMENA CHILDFREE PERSPEKTIF Maslȃhah Mursalah

Abstract

The progress of the times raises very complex problems that can affect each person personally. This can be seen from several young couples who choose childfree as their way of life after marrying the partner they love. This article aims to provide a review of Islamic law related to the childfree phenomenon which is increasing among young people. As for this research is a qualitative type research by taking a socio-normative approach. The way or method used as a way to explore and formulate this phenomenon is through Maslȃhah Mursalah. The findings in this study are that young people who adhere to childfree as a life choice are due to environmental factors and fears that will be caused by couples after having children, namely in the form of obstacles. In addition, it is caused by economic factors that are not yet established, causing couples to be afraid and choose not to have children. Apart from that, all community organizations have expressed their opinions related to childfreeism which is embraced by young couples, including Nahdhatul Ulama which considers that childfreeness is not justified by Islam. So that this is contrary to the purpose of marriage, one of which is to continue offspring and have children.
