Abstract

Marriage is a means permitted by religion to enjoy or have sexual intercourse with the opposite sex with the aim of continuing offspring in a happy and eternal household. The jurists generally discuss marriage in the chapter on muamalah, not in the discussion of worship. In the marriage process in various regions, it is wrapped in customs or traditions, just like marriage in the village of Pullau Hatta which preserves the kampana'a tradition, even those who are fanatical about customs make it one of the requirements for a valid marriage. Are all customs acceptable in Islamic law, or are there certain qualifications? The study raises the formulation of the problem How is the Islamic Law's View related to the implementation of the Kampana'a Tradition in the Buton Community marriage procession on Hatta Island. The research method uses field research to find primary data through observation, interviews and documentation. The data that has been prepared is analyzed qualitatively descriptively with easy-to-understand language. The results of the study Buton society recognizes three important things in life, namely birth, death and marriage. Marriage in the perspective of Buton society is legitimately segmented into two, namely legitimate in the optics of religion and legitimate in the optics of custom. The kampana'a tradition is one of the conditions for the validity of marriages carried out by the Butonese people. The kampana'a tradition, which is a legal requirement for marriage in Buton society, does not conflict with the values of Islamic teachings and is classified as a permissible custom/urf.
