Abstract

This study aims to analyze the role of the plenary sessions of the Supreme Court (SC) in the Religious Chamber in determining decisions related to hadhanah (child custody) within family law in Indonesia. Hadhanah is a crucial issue in family law, particularly in post-divorce disputes. The plenary sessions of the Supreme Court Religious Chamber play a significant role in establishing and enforcing Islamic family law, especially in hadhanah cases (child custody). This article seeks to examine the role of the plenary sessions in providing legal guidelines and maintaining consistency of religious court rulings in hadhanah dipsutes and their impact on justice for children. The findings show that the plenary sessions of the Supreme Court Religious Chamber play a central role in creating consistent legal standards in hadhanah cases while balancing the rights of parents with the best interests of the child.
